TERMS AND CONDITIONS OF SALE
Dunedin Stone Ltd (“the Company”) can provide a no obligation quote for any or all of your requirements. With our extensive knowledge and experience we can accurately evaluate projects of all sizes. Any drawings, designs and plans prepared by the Company at the customer’s request are provided for the purposes of calculating the measurements and quantities of goods required and for purposes of illustration only. It is the customer’s responsibility to check the measurements and quantities shown in the drawings, designs, plans and estimates against the physical location where the installation/fixing is to take place and to ensure the same are accurate in all respects. The Company does not accept liability for any inaccuracies in such documents or losses arising from the same if the customer has failed to carry out these checks and not informed us of any changes required. It is strongly recommended that customers request samples of stone before placing orders. It is the customer’s responsibility to ensure that the goods are suitable for their intended purpose and no warranty, condition or representation is given by the Company as to the fitness of the goods for any particular purpose unless otherwise expressly agreed. All orders are accepted on the express understanding that they are of natural stone, which is subject to natural formation characteristics including but not limited to variation in colour, texture and markings. Such variations, within our stringent tolerances, are part of the natural make up and appeal of stone and are not a defect. Only genuine natural stone offers this wonderful yet subtle variety and the ability to make your order truly unique. Any change to an order after confirmation will be re-priced and may incur additional cost. This will be notified to the customer as soon as possible and we reserve the right to refuse to accept changes once production has commenced. While we endeavour to adhere to quoted lead times, these are not guaranteed. Should unforeseen delays occur the Company willkeep the customer informed but does not accept responsibility for any further liabilities or charges. All goods sold incur VAT at the current standard rate. It is the customer’s responsibility to provide written confirmation from HM Revenue and Customs if they believe a particular project is to be zero rated, e.g. on a new build property. All goods are sold “ex works” with the option of delivery at cost through an external haulage company or collection from Macmerry Industrial Estate, East Lothian. All goods remain the property of the Company until paid for in full. Completed orders can be stored in our yard for customers who require call off over a period of time. There is no charge for this service but all goods will be invoiced as soon as production is complete and must be paid for in line with our normal payment terms. Risk of ownership passes to the customer at the earlier of the goods being dispatched from Company premises or moving into Company storage for later call off. If the goods are uplifted (i.e. the customer arranges transport), the Company accepts no responsibility for any damage, shortage or loss incurred in transit. Such claims must be made directly to the carrier. It is the customer’s responsibility to ensure that all current Health and Safety guidelines are adhered to for all loading and unloading operations. The Company can arrange carriage, freight insurance and any other transport costs if requested; such arrangements shall be at the customer’s expense and shall not affect the provisions of the contract as to the passing of risk. Customers who trade regularly with the Company can apply for a 30 day credit account. This will be subject to credit scoring through an external credit reference agency and we reserve the right to suspend a credit account at any time. Invoices become due 30 days from the invoice date; the Company reserves the right to charge interest at the rate of 3% per month above the UK bank base rate on any invoices outstanding over 30 days until paid in full. Non-account customers must pay a 50% deposit to confirm an order, with the balance due with cleared funds upon completion and before delivery or pick up of the goods. Alternatively, payment in full can be made at the time of order confirmation.
